According to ByteDance, at the beginning of this year, the company's technical team just began to conduct initial exploration of large models, and some engineers applied GPT's API services to experimental project research on smaller models. This model is only for testing, there is no plan to go online, and it has never been used externally. This practice has been discontinued as the company introduced GPT API call specification checks in April.
ByteDance stated that in April this year, the Byte Big Model team put forward clear internal requirements that data generated by the GPT model must not be added to the training data set of the Byte Big Model, and trained the engineering team to comply when using GPT. In September, the company conducted another round of internal inspections and took measures to further ensure that API calls to GPT meet regulatory requirements, such as sampling in batches to detect the similarity between model training data and GPT and preventing data annotators from using GPT without permission.
ByteDance stated that it will conduct a comprehensive inspection again in the next few days to ensure strict compliance with the terms of use of relevant services.
Previously, on December 16, foreign media reported that Bytedance was purchasing OpenAI’s API access/usage rights through Microsoft to develop its own large language model, including model training and evaluation. OpenAI's terms of service stipulate that OpenAI's model output cannot be used to "develop any AI models that compete with our products and services." Microsoft also pursues the same policy. After discovering this behavior by ByteDance, OpenAI has suspended the company's account.
Subsequently, OpenAI spokesperson Niko Felix issued a statement that day, confirming that ByteDance’s account had been suspended: “All API customers must comply with our usage policy to ensure our Technology is used for legitimate purposes. Although ByteDance uses our APIs sparingly, we have suspended its account while we investigate further. If we find that ByteDance's use does not comply with these policies, we will require the other party to do so. Make the necessary changes or terminate their account."
