Recently, the People's Court of Suixian County, Suizhou City, Hubei Province heard a case involving providing e-commerce services to fake orders and increase positive reviews. The defendants made more than 10 million yuan in profit from fake orders, and were sentenced to fixed-term imprisonment and fined.
The facts of the case show that in 2021, the defendant Zeng Moumou and four other people purchased a variety of bill-falsifying software many times, and operated payment and settlement business without obtaining a value-added telecommunications business license and without approval from the People's Bank of China. Rent an office space, hire people to contact merchants to carry out order manipulation business, and help merchants create the illusion of high product sales and good quality, making a total profit of more than 10 million yuan.
Online merchant Wu Moumou and three other people contacted Zeng Moumou in order to increase the sales of the online store. They faked orders through the ordering platform and conducted false propaganda through fictitious transactions and fabricated user reviews, making a total of more than 1 million yuan in illegal profits.
In 2022, Huang Moumou, who was operating a fraud platform, was arrested by the public security organs, and six other people also surrendered one after another. The procuratorial organ filed a public prosecution with the Suixian People's Court on charges that the defendant Zeng and three others were guilty of illegal business operations, and that the defendant Wu and three others were guilty of false advertising.
The court held that the defendant Zeng Moumou and four other persons violated national regulations by providing paid services such as publishing false information through information networks for the purpose of profit without obtaining a value-added telecommunications business license, and provided services such as publishing false information for a fee without obtaining a license for value-added telecommunications business in China. When the People's Bank of China approved the operation of payment and settlement business, they illegally engaged in fund payment and settlement business through fictitious transactions and other methods. The actions of the four people all seriously disrupted the market order, and the circumstances were particularly serious, and they all constituted the crime of illegal business; the defendant Wu A certain person and three other persons violated state regulations and used advertisements to falsely promote goods or services. The acts of these three persons all violated the state's management system for advertising operations, and the circumstances were serious. They all constituted the crime of false advertising.
In the end, the court sentenced Zeng Moumou and four other people on the order fraud platform to three years in prison for illegal business operations, with probation ranging from four to five years, and fines ranging from RMB 2.7 million to RMB 4.5 million. Internet merchant Wu Moumou and three other people were sentenced to ten months' imprisonment, suspended for one year, and fines ranging from RMB 30,000 to RMB 40,000 for the crime of false advertising. At the same time, all illegal income of the seven people was recovered.
