This afternoon, lawyer Fang Zhuyuan, the plaintiff in the much-watched "iQiyi Screen Casting Restriction Case", posted on Weibo, turning his attention to another major online video platform, Youku, and raised questions about the platform's screen casting service. Four major doubts.
Lawyer Zhu Yuan pointed out on Weibo that the Youku platform made it clear in its official statement that screencasting does not belong to the rights and interests of VIP members. However, in actual operation, it has opened the screencasting function for some content, making members feel like they are casting when they cast. "Opening the blind box" makes it impossible to clearly understand what content can be viewed on the screen. In this regard, lawyer Zhu Yuan asked, "Is this also a kind of unclear boundary of members' rights and interests, and is it harmful to consumers' right to know?"
Attorney Zhu Yuan raised four major questions about Youku’s vague and specious screen casting policy. He said:
1. Youku, please tell me, you said that screen casting cannot be used on TV, why can some cast and some cannot? ?
2. Youku, please tell me, I want to distinguish which ones can be voted on and which ones cannot be voted on. Why are there marked "VIP frame sharing", "first broadcast" and "exclusive broadcast"? Some can be voted on and some cannot be voted on?
3. Youku, please tell me, you said that screencasting cannot be used on the TV, but now it can be used partially. Is this "partial use" a member's rights stipulated in the membership agreement? Or is it, as iQiyi said, a member's rights stipulated in the membership agreement? Other than free gifts?
4. Youku, please tell me, you said that screencasting cannot be used on TV, why can’t it be used on “macbook air” devices?
It is reported that the "iQiyi screencasting restriction case" that has attracted much attention from netizens earlier this month was ruled in favor of the plaintiff in the first instance. As the defendant, iQiyi needs to compensate the plaintiff for 41 days of gold membership VIP time. However, both the plaintiff and the defendant appealed against the verdict. Among them, the plaintiff's lawyer Zhu Yuan requested that iQiyi should treat single-time members and continuous monthly members with the same treatment. There are errors in application, and the company is not obligated to provide screencasting services with a resolution higher than 480p to gold members permanently and free of charge.
