According to media reports, surveillance video of singer Jolin Tsai riding the Chongqing light rail recently leaked, and a suspected Chongqing rail transit employee pointed at the screen. In response to this, Chongqing Rail Group said that it is currently confirmed to be the work of internal personnel and will be dealt with seriously after verification.
Star chasing? Chasing profit? It is unclear why Chongqing Light Rail "insiders" spread the Jolin Tsai video. But no matter what the purpose is, as a natural person, there is no right to distribute videos in public places that involve personal privacy. Even if the other party is a public figure and can transfer some of his rights, his private itinerary does not fall into the category that must be disclosed.
installs surveillance video systems in public places to maintain social order, prevent and combat crime, and protect public safety. Relevant parties have strict laws and regulations on this. Only under certain circumstances, such as investigation and evidence collection, or for public interest needs, relevant departments have the right to view and use these surveillance videos.
Jolin Tsai traveling by light rail outside of holding concerts is completely a private matter. Chongqing Light Rail insiders arbitrarily leaked and disseminated her itinerary, which not only violated Jolin Tsai's right to privacy, but also violated the regulations on the use of surveillance in public places. It may even cause the public to be worried and lack trust in the public surveillance system. This must be strictly investigated and dealt with.
First of all, we must find the source and channel of outflow and strengthen source management. How did public surveillance footage leak out? Is it an accident, or is it a regular illegal operation? Is it an individual act or an organized act? Is it out of curiosity or fun, or is there some kind of business deal behind it?
These questions must be investigated clearly. They cannot be fooled by just saying "I'm sorry" and "I will deal with it". This is not only an explanation to Jolin Tsai, but also an explanation to society. After all, when it comes to the protection of personality rights, every citizen’s rights are the same and should be protected.
In addition, relevant institutions and personnel must be held legally responsible. Of course, handling it within the unit is a must, but this matter is obviously not an internal matter, but a matter of public safety. Not only individuals must be dealt with, but units should also bear corresponding responsibilities.
The "Civil Code" stipulates: "Natural persons have the right to privacy. No organization or individual may infringe on the privacy rights of others by means of spying, intrusion, leakage, disclosure, etc." The "Personal Information Protection Law" also stipulates that no organization or individual may illegally Collect, use, process, transmit, and disclose other people's personal information.
Regarding this matter specifically, the parties may require the perpetrator to bear civil responsibilities such as ceasing the infringement, eliminating the impact, making an apology, and compensating for losses in accordance with the Civil Code. Law enforcement agencies may also impose fines, detention and other public security penalties on those suspected of leaking other people's privacy in accordance with the provisions of the Public Security Administration Punishment Law. And if this public video is accessed by unrelated insiders or can be regarded as illegal intrusion, the relevant personnel are also suspected of illegally obtaining citizens' personal information.
In recent years, surveillance videos in public places have been leaked and disseminated frequently, which has made many people worried. Earlier, some netizens broke the news that a certain social platform had many surveillance videos suspected of hacking cameras in public places such as schools and hospitals, which attracted widespread attention. Last year, an indecent video leaked from Yushan Forest Park in Changshu, Jiangsu Province. While the person involved was condemned, it also aroused public concerns about the leakage of public videos.
When surveillance videos in public places are abused and spread maliciously, not only will citizens have no privacy at all and become "transparent people" who can be peeped at will, but it will also seriously damage the public interests of this society. In this sense, the Jolin Tsai incident is another wake-up call for everyone.
