The Beijing Higher People's Court made a judgment and upheld the original judgment.
Baidu’s apology statement
Baidu stated in its apology statement that it had taken the initiative to fulfill all the terms of the (2017) Jing 73 Min Chu No. 1914 Civil Judgment. In accordance with the second requirement of the main text of the judgment, we now publicly apologize to NavInfo.
public information shows that NavInfo was founded in 2002 and is a leader in the fields of navigation maps, dynamic traffic information, and customized Internet of Vehicles solutions for passenger cars and commercial vehicles.
In early January this year, NavInfo issued an announcement stating that it had received the final judgment of the case, and the final judgment was to “reject the appeal and uphold the original judgment.”
NavInfo said that it began business cooperation with two companies from Baidu in the field of electronic map data in 2009, and later reached a "Cooperation Agreement" in 2013. According to the Cooperation Agreement, NavInfo authorized the two companies to use its electronic map works within the scope of the agreement and paid corresponding license fees to NavInfo. The contract is valid until the end of 2016.
However, after the contract expired, the two parties did not renew it. After the termination of the Cooperation Agreement, Baidu will continue to use the electronic maps provided by NavInfo, provide electronic map products to the public through computer terminals, mobile terminals, etc., and provide electronic maps on vehicle-related applications beyond the scope of the original contract. .
According to the judgment disclosed by NavInfo, Baidu not only needs to publish an apology statement in the media, but also needs to compensate for economic losses of 64.5 million yuan, reasonable expenses of 926,600 yuan, and stop infringing the copyright of NavInfo-related graphic works.
