The house involved was Huang Xiaoming’s real estate in Chaoyang District, Beijing. The plaintiff of
Huang Xiaoming claimed that he signed a sales contract with Zhang Moulong (only 13 years old at the time) in 2013, and paid 36 million yuan for the purchase of the house as agreed and lived for a long time after renovation. Later, Huang Xiaoming asked Zhang Moulong to cooperate with the registration procedures for the transfer of ownership, but Zhang Moulong avoided seeing him.
Zhang Moulong argued: 1. At the time of signing the contract, he was only 13 years old. He was a person with limited capacity and believed that his parents’ authorized behavior was invalid. 2. He has not received the transfer money so far. 3. There are two legal relationships between the house involved and Huang Xiaoming, the relationship between the sale and purchase contract and the relationship between the mortgage contract.
After the trial, the court held that the house sale contract signed by Huang Xiaoming and Zhang Moulong was valid, but because the house was sealed up many times and it had not been unblocked before the conclusion of the debate in this case. Therefore, Huang Xiaoming's request for the registration of ownership transfer was a request that could not be fulfilled in fact, and it was not supported by the court in the end.
